Philips Medical Supplies Guarantee

We guarantee our supplies products against defects in materials and workmanship for a minimum of one year or the balance of the product's shelf life.*

*Some products have guarantees longer than one year. For further information and a complete statement of warranty terms and conditions, contact your local Philips Medical Supplies representative.

Place of Performance

Products must be returned to a service facility designated by Philips. Contact your local Philips Sales Office for information on where to return products. The customer shall prepay shipping charges (and shall pay all duty and taxes) for products returned to Philips for warranty service. Except for products returned to the customer from another country, Philips shall pay for return of products to the customer.

Limitation of Warranty

The foregoing warranty shall not apply to defects resulting from any of the following:

Improper our inadequate maintenance by the customer
Customer-supplied software or interfacing hardware
Unauthorized modification or misuse
Operation outside of the environmental specifications for the product
Improper site preparation and maintenance

The warranty set forth herin is exclusive and no other warranty, whether written or oral, is expressed or implied.

Philips specifically disclaims the implied warranties of merchantability and fitness for a particular purpose.

Limitation of Remedies and Liability

The remedies provided herein are the customer's sole and exclusive remedies. In no event shall Philips be liable for direct, indirect, special incidental, or consequential damages (including loss of profits) whether based on contract tort, or any other legal theory.

The foregoing limitation of liability shall not apply in the event that any Philips product sold hereunder is determined by a court of competent jurisdiction to be defective and to have directly caused bodily injury, death, or property damage, provided that in no event shall Philips liability for property damage exceed the greater of $50,000 (US) or the purchase price of the specific products that caused such damage.
